Terms of Service

These Terms of Service govern your access to and use of ClipMelody. By using the service, you agree to these terms.

What ClipMelody is, and who it is not

ClipMelody identifies the song playing in a piece of media. You give it a link to a public TikTok, Instagram or YouTube video, a file, or a recording, and it tells you which recorded song it hears, with links to listen elsewhere.

ClipMelody is an independent tool. It is not affiliated with, endorsed by, sponsored by, or connected to TikTok, ByteDance, Instagram, Meta, YouTube, Google, Shazam, Apple, Spotify or any of their affiliates. Those names and marks belong to their owners and are used here only to describe what the tool works with. ClipMelody never asks for your credentials on any of those platforms.

What the service does not do

Being plain about the boundary is part of the product, so it is part of these terms too. ClipMelody cannot and does not:

• Reach private, deleted, age-restricted or region-locked videos, or live streams.
• Identify humming, whistling, singing, or music that is not in a commercial catalogue.
• Guarantee that every song is found, or that a match is the exact edition you heard.
• Download, store or redistribute the videos it listens to.

Eligibility

You must be at least 13 years old (or 16 in the EEA and UK, where a higher age applies), be able to form a binding contract, and comply with all applicable laws.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.

Acceptable use

You agree not to:

• Violate laws, regulations, or third-party rights.
• Upload content you do not have the right to share with us, or content that is unlawful.
• Interfere with, reverse engineer, scrape, overload, or disrupt the service.
• Attempt to bypass security, rate limits, free-use limits, billing, credits, or access controls.
• Use the service to create or distribute malware, spam, or fraudulent activity.

Results

A result is a best match from an automated recognition service, not a statement of fact about who made or owns a recording. Song titles, artists, artwork and previews come from third-party catalogues and belong to their owners. Listening links are searches on the named services; what they return is up to those services.

Result pages for public videos can be opened by anyone with the link, because the same video has the same answer for everyone. Do not upload a file whose result page you would not want someone you share the link with to see.

Copyright

We respect intellectual property rights. If you believe content on the service infringes your copyright, send a notice to hello@clipmelody.com with: identification of the work, the material you claim is infringing and its location, your contact details, and a statement that you have a good-faith belief the use is unauthorized. We may remove infringing content and terminate repeat infringers.

Payments, credits, and subscriptions

One credit identifies one song, and a credit is used only when a match is found. Prices, included credits, renewal terms and expiry are shown at checkout and on the pricing page. Taxes may apply.

You authorize us and our payment provider to charge applicable fees. Failure to pay may result in limited access, suspension, or termination. Refunds are governed by our Refund Policy.

Third-party services

The service runs on third-party providers for hosting, video retrieval, audio processing, music recognition, database, payments, sign-in, email and analytics. They are named individually in our Privacy Policy. Your use of the service may be affected by their own terms, outages or changes.

Intellectual property

The service, software, branding, design, and related materials are owned by us or our licensors. Except as expressly allowed, you may not copy, modify, distribute, sell, or lease any part of the service.

Suspension and termination

We may suspend or terminate access if you violate these terms, create risk for the service or other users, fail to pay fees, or use the service in a way that may expose us to liability.

You may stop using the service at any time. Certain sections of these terms will survive termination where their nature requires it.

Disclaimers

The service is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or secure, or that any particular video can be read or any particular song identified.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability for any claim relating to the service will not exceed the greater of the amounts you paid to us for the service in the twelve months before the event giving rise to the claim, or USD 100.

Indemnification

You agree to indemnify and hold harmless ClipMelody and its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of content you upload, your use of the service, or your violation of these terms or applicable law.

Your local law still applies

ClipMelody names no governing law and no exclusive forum. Nothing in these terms removes or limits any mandatory consumer protection, refund right, or cancellation right available to you where you live.

If something goes wrong, write to hello@clipmelody.com first. Most of what these terms cover — a charge, a refund, a wrong match — is faster to settle that way.

General

These terms, together with the Privacy Policy, Refund Policy, and Cookie Policy, form the entire agreement between you and us regarding the service. If any provision is found unenforceable, the remaining provisions stay in effect. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce any right is not a waiver of it.

Changes to these terms

We may update these terms from time to time. Continued use of the service after changes become effective means you accept the updated terms.
